Similasan has agreed to pay $3.575 million to settle claims that it falsely advertised its eye drops as homeopathic, sterile, and safe, despite allegedly containing undisclosed ingredients such as silver sulfate. The products were also sold under store brands at CVS and Walgreens.
Plaintiffs in the lawsuit claim that labeling the drops as “homeopathic” and “sterile” misled consumers, particularly given the lack of scientific support for homeopathy and the alleged failure to disclose potential risks. The lawsuit also argues that the presence of silver sulfate, a chemical associated with eye discoloration, was not disclosed on packaging.
Similasan denied all allegations of wrongdoing but agreed to settle to avoid further litigation.
Class members can receive payments based on the number of products they purchased:
Without proof of purchase: Up to four products for a flat payment of $10
With proof of purchase: $2.50 per product, no cap on the number of items
If the number of valid claims is lower than expected, payments may increase. If there are more claims than anticipated, payments may be reduced on a proportional basis. Any unclaimed settlement funds will be donated to The Public Justice Foundation, a nonprofit advocacy group.
This settlement helps resolve consumer concerns over product transparency and reinforces labeling standards in over-the-counter homeopathic treatments.
